How the Rules of Intestacy Work in the UK
The Rules of Intestacy UK follow a structured legal pathway. Below is a simplified explanation of how an estate is distributed when there is no Will.
Step 1: Is there a surviving spouse or civil partner?
If yes, they inherit all or part of the estate depending on its value and whether there are children.
Step 2: Are there children?
If there is a spouse and children, the estate is divided between them under statutory rules.
If there is no spouse, children inherit equally.
Step 3: If no spouse or children
The estate passes to parents.
Step 4: If no parents
The estate passes to siblings (or their children if they have already passed away).
Step 5: If no close relatives
The estate moves further along the family line.
Step 6: If no eligible relatives can be found
The estate passes to the Crown (known as Bona Vacantia).
